AGREEMENT | TERMS AND CONDITIONS | NOTES
All trips operated by Mawe African Ventures Company Limited. By the below terms and conditions.
Clients receive a detailed itinerary describing the different places they will go and things they will see, so they know what to expect. The safari services agreed with the client will be provided, except in the event of unforeseen circumstances, such as road closures, bad weather, problems or security considerations. In such cases the itinerary may be changed, at the discretion of the company, clients informed and alternative arrangements made as circumstances permit. Mawe African Ventures Company Limited will make every reasonable effort to ensure the same quality and character of the itinerary.
Clients must accept that conditions in Tanzania are not the same as those in developed countries. In Tanzania, we are exposed to unannounced and sudden changes in government regulated fees and taxes, such as national park fees and taxes. Mawe African Ventures Company Limited has the right to pass these local taxes/fees on to their customers.
CHILD POLICY
(A child is considered 5–15 years in Tanzania. Please note that some partner lodges and camps may apply higher minimum age limits depending on location and camp design; these will be advised at the time of booking.)
- Children 4 years and under:
We generally do not recommend that children 4 years and under stay in remote safari properties inside national parks or game reserves. Some of our partner camps may not accept very young children; we will advise case by case at the time of enquiry. - 1st Child sharing with 1 or 2 adults in the same room enjoys FOC on FB (Full Board) and GP (Game Package) basis.
Note: When a child is sharing with only 1 adult, the adult will be charged the single room rate.
- 2nd / 3rd Child sharing with adult(s) in the same room enjoys 50% discount on FB/GP basis.
- Child in own room:
The child must be at least 14 years of age to stay in their own room and will be charged the same rate as an adult paying the single FB/GP rate.
An additional 1st child sharing in the same room stays FOC on FB/GP.
An additional 2nd child sharing the same room receives a 50% discount on the per-person sharing FB/GP rate.
Any applicable circuit or long-stay discounts will apply as normal on child FB/GP rates in their own room.
Room Configuration in Standard Safari Suites/Tents
- Maximum 2 children in a room sharing with 2 adults, or 3 children sharing with 1 adult (subject to specific property configuration).
- Typical bed configuration:
- 1 super king bed | 1 sofa bed | 1 camp safari bed
or - Twin beds | 1 sofa bed | 1 camp safari bed
- 1 super king bed | 1 sofa bed | 1 camp safari bed
- Sofa bed is ideal for children up to 16 years.
- Safari/camp bed is ideal for children up to 12 years.
Important:
Rates are charged based on the children’s ages at the time of travel for accommodation, park fees, camping and/or concession fees. Should we, on arrival, note that children are older than previously declared, any additional fees will be charged directly to the guest/agent.
Please ensure that children’s ages are correct at the time of travel when requesting a quote and confirming a booking.
MEDIVAC EVACUATION COVER (TANZANIA ONLY)
(Applies to guests booked on Game Package basis only. For guests booked on Full Board only, the responsibility for medical evacuation lies with the Tour Operator / Travel Agent / DMC or the client if booking directly.)
It is our understanding that all guests will travel with appropriate travel insurance. Should they choose not to, please note that Mawe African Ventures Limited does not automatically provide medical evacuation cover.
Should you wish us to arrange a medical evacuation membership or cover for your guests, we will be happy to do so at an additional cost. However, it is a condition of acceptance of any booking with us that your guest(s) must be fully insured by a comprehensive policy that covers:
- All activities undertaken during the safari,
- Medical and emergency treatment,
- Holiday and cancellation cover,
- Evacuation and repatriation,
- Baggage and personal effects.
If you require us to add evacuation cover to bookings on GP, please indicate clearly at the time of booking.
CONFIDENTIALITY
The terms and conditions outlined in this contract are confidential and may not be disclosed, posted, or made accessible to third-party internet sites, corporate travel conferences, or incentive groups. Any distribution or exposure of our net tour rates will result in the immediate termination of the agreement.
ALTERNATIVE ACCOMMODATION
In the rare occurrence of circumstances beyond our control necessitating a change in the confirmed booking, Mawe African Ventures Limited reserves the right to reroute guests to an alternative property of equivalent standard, subject to availability.
PROVISIONAL BOOKINGS
- Reservations will be provisionally held for 14 days from the date of the initial email.
- If no further communication regarding extensions or confirmation is received within this period, the booking will be automatically released from our system.
- Extension of provisional bookings is subject to availability and will only be granted if there are no confirmed bookings on the waitlist for the same dates.
PAYMENT TERMS
- Reservations must be confirmed in writing by email, after which a proforma invoice will be issued.
- On acceptance of our quote, Mawe African Ventures Limited will require a 20% deposit to confirm the safari.
- Full and final payment is due 46 days prior to the start of the safari.
- Failure to receive full payment 46 days before arrival may result in the release of the booking and forfeiture of the deposit.
Last-Minute Bookings
- 1 Month Prior bookings are payable by cash deposit or instant bank transfer before arrival, unless prior arrangements are agreed in writing.
- Cheques are not accepted for last-minute bookings.
Failure to pay on time may result in automatic cancellation of the booking, with cancellation penalties payable to us and any third-party service provider, as per their terms and conditions.
Proof of payment (bank transfer confirmation or deposit slip) must be emailed to our reservations team (contact details as provided on your proforma invoice).
Our costings include a fixed bank charge to cover expenses incurred by international bank transfers, as invoice amounts are to be received net of charges.
Payments via credit card may attract a handling fee (percentage as advised at time of booking).
CANCELLATIONS AND CREDIT NOTE POLICY
All cancellations of confirmed bookings must be made in writing or via email.
By confirming a booking with our company, the agent/client acknowledges and agrees to the following cancellation terms.
No Refund Policy
We operate a strict no-refund policy.
No refunds will be issued under any circumstances, including but not limited to voluntary cancellation, travel delays, airline disruptions, medical situations, force majeure events, or failure to travel.
All payments made to the company, including deposits and full balances, are non-refundable.
Credit Note Policy
- For cancellations received 46 days or more prior to arrival, a Credit Note may be issued at the sole discretion of the company for any recoverable portion of the safari cost.
- No Credit Note will be issued for cancellations made 45 days or less prior to arrival.
- Credit Notes are non-transferable unless otherwise agreed in writing.
- Credit Notes must be used within the validity period stated on the issued document.
- The issuance of a Credit Note is not automatic and remains entirely at the company’s discretion.
Third-Party Services
Airline tickets, accommodation, park fees, permits, conservation fees, and other third-party services are subject to the terms and conditions of the respective service providers.
All amounts paid toward third-party services are strictly non-refundable. No refund will be issued for cancelled third-party arrangements.
Where applicable, and only if funds are recoverable from suppliers, such amounts may be considered toward a Credit Note, subject to this policy.
Failure to Travel or Unused Services
If clients fail to join the safari, arrive after the confirmed departure date, or leave before the confirmed end date, no refund or Credit Note shall be issued for any unused services.
Travel Insurance Requirement
It is the sole responsibility of the agent/client to ensure that all travelers obtain comprehensive travel insurance valid from the date of booking confirmation. Insurance must cover cancellation, curtailment, medical emergencies, evacuation, and any unforeseen circumstances.
REFUNDS
We strive to ensure that all anticipated services and accommodation are provided as planned. However, in the rare event that any accommodation or excursion is unavailable, or the client is unable to use a service for whatever reason, Mawe African Ventures Limited accepts no liability for refunds, in part or in whole, unless expressly agreed in writing.
DMC GROUND HANDLING WAIVER
In the event of cancellations, changes, or delays to client ground handling arrangements by any of our suppliers (including flights, transfers, and accommodation bookings), we will endeavor to assist clients in the field with rearrangements to minimize disruption to their itineraries.
However, any costs incurred by us in this regard will be charged directly to the client or agent. This includes, but is not limited to:
- Missed flight connections,
- Return of lost luggage to clients,
- Any requested changes to the itinerary after the safari has commenced.
We are not liable for any travel arrangements made directly by the agent or client with any supplier, except for arrangements booked directly through Mawe African Ventures Limited and/or our contracted partners.
BAGGAGE
Due to the use of small/light aircraft with limited luggage capacity, passengers may only use soft bags with a maximum total weight of 15 kg per person (including hand baggage).
These limitations are strictly adhered to on all flights within Tanzania and on regional flights in East Africa. Excess baggage may be refused or charged extra by the airline.
INSURANCE
All guests, without exception, must have comprehensive medical and travel insurance when traveling with our company, affiliates, associate companies, or third-party suppliers. Insurance should cover (but is not limited to):
- Medical expenses and emergency evacuation
- Baggage loss, theft, and damage
- Flight delay or cancellation
- Repatriation
- Trip changes due to circumstances beyond our control
- Third-party amendments or cancellations
- Change of itinerary or cancellation of safari
Any associated costs will be deemed payable in full and in advance by the guest/agent if such a case should arise.
TRAVEL DOCUMENTS AND HEALTH
Guests are personally responsible for ensuring that passports, visas, travel permits, health certificates, inoculations, and other documents required for travel are obtained and remain in order for the duration of the trip.
Mawe African Ventures Limited, its staff and agents are not responsible for any failure to comply with these requirements.
Health: Guests should consult their own GP or travel clinic regarding recommended vaccinations and sensible medical precautions for travel in East Africa. It is essential that all guests have a comprehensive travel insurance policy from the moment their safari arrangements are confirmed.
Travel Advisories: We strongly recommend that all guests consult the advice of their local foreign office / state department regarding travel to Tanzania and East Africa.
Cancellation charges will still apply if a confirmed trip is cancelled for this or any other reason, including changes in travel advisories.
FORCE MAJEURE
- a) “Force Majeure” means, in relation to Mawe African Ventures Limited, any circumstances beyond the reasonable control of the Company, including but not limited to: war or threat of war, sabotage, civil disturbance, requisition, acts of God, fire, accident, flood or explosion, sickness, quarantine, government intervention, weather conditions, pandemics/epidemics, or other unforeseen occurrences.
- b) If the Company is affected by Force Majeure, it shall notify you as soon as reasonably practicable of the nature and extent thereof.
- c) The Company shall not be deemed to be in breach of these terms and conditions, nor otherwise be liable to you, by reason of delay in performance or non-performance of any of its obligations to the extent that any such delay or non-performance is due to Force Majeure.
- d) If affected by Force Majeure, the Company shall be entitled, in its sole and absolute discretion, to cancel or vary any arrangements or itinerary in relation to the safari. Any refund will remain at the Company’s sole discretion. The Company will use reasonable endeavors to reimburse you where possible, but shall be entitled to deduct from any refund the reasonable actual and potential costs to the Company resulting from the Force Majeure.
- e) Regarding civil unrest, once the Company has investigated the prevailing situation as it deems fit, it shall remain in the Company’s sole discretion whether to proceed with the safari. You may in such circumstances cancel the trip; however, if after making all reasonable inquiries the Company is of the opinion that the trip may proceed safely, no refund will be payable to you and the refund provisions above will apply.
DISPUTES
Any disputes regarding reservations, payments, or complaints about quality of service should be made in writing/email to our Reservations Team while guests are still in-house, so that we may have the opportunity to rectify the problem.
Thereafter, any complaint must be submitted in writing within 14 days of departure in order for us to reasonably assist in resolving the matter.
These conditions apply to all associate and affiliate companies (including, but not limited to, lodges, hotels, tented camps, mobile camps, transport and ground handling partners used by Mawe African Ventures Limited).
CHANGES IN RATES
Mawe African Ventures Limited and its partners will endeavor to maintain agreed rates, but reserve the right to change rates and terms at any time, particularly (but not limited to) due to:
- Camping / concession / conservancy / conservation fee adjustments
- VAT or other government tax increases
- New levies or fees imposed by authorities or landowners that affect our operational costs
In the event of such increases, we will promptly advise and re-invoice the agent or client. We will attempt, where possible, to honor existing confirmed and deposited bookings, but reserve the right to pass on any new or increased charges.
SURCHARGES
Although the Company hopes not to levy surcharges, it reserves the right to do so on the invoiced amount if required due to:
- Increases imposed by agents or suppliers,
- Adverse exchange rate fluctuations,
- New government levies or taxes,
- Changes in park, reserve, conservation area, community or concession fees,
- Significant increases in fuel prices.
The Company will endeavor to notify you in writing as soon as it becomes aware of any such surcharge. This surcharge will apply to all confirmed and invoiced safaris, regardless of whether full payment has already been received.
Please note this can often occur when guests arrive early on day 1 or depart late on the final day, thereby incurring additional park fees, meals or game drive services. Be mindful that parks and conservation areas typically allow only a short grace period (e.g. 15 minutes) beyond the permit exit time; exceeding that may generate additional fees.
PHOTOGRAPHY
The Company reserves the right to make use of any photography or film taken on safari by our staff or on our vehicles for general publicity and marketing purposes without payment or written permission from the client or tour operator, unless otherwise agreed in writing in advance.
AIRLINES
Carriage by the airlines concerned is subject to the terms and conditions of the carrier and to international travel conventions. Mawe African Ventures Limited has no control over airline operations and accepts no liability for cancellations, delays, or schedule changes.
All flights are subcontracted to independent aviation companies who are entirely responsible, and thus liable, for all aspects of the flying operation.
All safari details are correct at the time of communication. Mawe African Ventures Limited will not be held responsible for any changes or inaccuracies that may occur thereafter.
JURISDICTION
This agreement is made subject to, and shall be governed by and construed in accordance with, the laws of the United Republic of Tanzania, notwithstanding its place of performance or acceptance. All actions arising hereunder shall be brought in the courts of Tanzania.
Notice of enforceability – Kindly note:
When you book travel-related services with Mawe African Ventures Limited or its agents, you are entering into a binding agreement that assumes all terms and conditions are fully understood as stated in any Company documents. The agent is responsible for ensuring that their clients are fully aware of the latest Terms and Conditions.
LIABILITY
Mawe African Ventures Limited and any of its ownership, associated companies, affiliates, partner lodges, camps, transport providers and activity operators will not accept any responsibility for any accident, incident, loss, injury, illness, death, or damage of any nature involving clients/guests and/or staff:
- At any of the properties used,
- While traveling to or from any properties,
- Or while partaking in any activity arranged by, associated with, or booked through the Company or its associates.
Travel and participation in safari activities are undertaken entirely at the guest’s own risk, and guests are required to have appropriate insurance as noted above.
BREACH
Mawe African Ventures Limited will consider any default or non-compliance with any of the terms and conditions contained in this agreement as a breach of contract, which may render this contract null and void.
Furthermore, the Company may cancel any booking, paid or unpaid, as a result of such breach and may claim damages arising from the default.
Website pricing
All prices published on maweafricanventure.com are per person, based on two persons (unless otherwise stated) and quoted in US dollars (US$). Cost of obtaining passports or visas, border taxes (if applicable), tips for guide, driver and hotel staff, insurances, additional excursions or personal expenses are not included in the itinerary cost. Discount rates for children or peak-rates during high/festive season are not included. All prices on the website should be used as a guideline only. Mawe African Ventures cannot be held responsible for any changes or pricing errors. Mawe African Ventures will specify all cost in their invoices. The quotations are valid for 2 weeks.
Insurances
It is a condition of booking, that the sole responsibility lies with the guest to ensure that they carry the correct comprehensive travel and medical insurance to cover themselves, as well as any dependents/travelling companions for the duration of their trip to Tanzania. This insurance should include: medical expenses and repatriation expenses. Optional insurances are: cancellation or curtailment of the safari, emergency evacuation expenses (flying doctors), damage/theft/loss of personal baggage, money and goods.
Passports and visas
It is upon the guest to ensure that passports and visas are valid for the countries visited. Most nationalities can get a tourist visa on arrival in Tanzania at the border/airport ($50 per person, US Citizens $100 per person). This tourist visa is valid for a period of three months. You can also get your visa in advance at the embassy in your home country. Check the visa rules before you go. Passports should have at least six months of validity after the final day of travel. Mawe African Ventures cannot be held liable for any visas, etc. not held by the guests, nor the cost of visas.
Check names
Please check the names on the invoice carefully when you receive our invoice. In case we need to change a name, 3 or more days after you received our invoice, we are obligated to charge a fee of $130,-
Making a booking with Mawe African Ventures is taken as acceptance by the customer of above Terms and Conditions.
The holidays featured on our website Safarogo.com and SafariBooking.com are operated by Mawe African Ventures Company Limited.
ACCEPTANCE OF TERMS
By booking our services, you agree to be bound by the Terms and Conditions outlined herein. Your booking serves as your acceptance of these terms and constitutes a binding agreement between you (and/or your clients) and Mawe African Ventures Limited, together with its affiliates and contracted partner service providers.
